This commentary analyzes the investigative case of the Chilean National Economic Prosecution Service (FNE), ROL F255-2020, corresponding to the acquisitive operation carried out between Naturgy Energy Group S.A (hereinafter Naturgy S.A) and State Grid International Development Limited (hereinafter State grid). The aforementioned concentration operation sought to transfer control of the Compañía General de Electricidad S.A (CGE), held by Naturgy S.A, to the foreign state company China State Grid, an operation that meant for the Chinese government to obtain the shareholding majority of one of the most relevant electricity providing companies in Chile. Through the study of this operation, and of the administrative procedure carried out by the FNE, I seek to analyze the treatment given to foreign direct investment in Chile, framing the study under a conscious gaze of the national strategic sectors and how national security could be potentially affected as a result of foreign investment in vital areas of the Chilean economy.
