Abstract

This work analyzes a Chilean court decision related to State succession following the War of the Pacific. The analysis focuses on how Chile, upon occupying Tarapacá, subrogated itself into Peru’s contractual obligations. It examines whether there was legal continuity or a rupture (novation). The issue of State succession is compared to the paradox of the “ship of Theseus”. This judgment anticipates current principles of international law.
