Trade, Investment, and Climate Change in the Context of the CPTPP [3.3355]

Although trade and investment agreements were not originally designed to achieve climate objectives, we must ask whether they have become an obstacle to reaching such goals or if they are compatible with efforts to achieve the energy transition towards carbon neutrality. With a special focus on the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), this essay analyzes the various positions in the doctrine on this issue. It reveals the existence of a critical position on compatibility, a favorable position, and a third position that considers trade agreements not only compatible with climate objectives but also a useful tool for achieving them.
