Abstract

One of the most controversial phenomena directly related to environmental law is climate change. For this reason, the purpose of this commentary is to analyze the rulings handed down in cases R-77-2018 and R-36-2020 of the Third Environmental Court and pays special attention to the consideration of the so-called "climate factor" in the environmental assessment. Both rulings unequivocally establish that our legal system did not require including the climate factor in environmental impact studies; however, Law 21455, known as the Framework Law on Climate Change, does impose this obligation. In view of the future decisions of the courts, the study of the two rulings will allow making comparisons.
