The Chilean Supreme Court has accepted the doctrine of the presumption of fault for one's own act due to dangerous activities, based on Art. 2329 of the Civil Code. This article takes a critical look at a judgment in which the Court recognizes this presumption, but demands such requirements for its validity that this recognition ends up being illusory.
